General Terms and Conditions (GTC)

1.1 Operator

ImmoPoint is an online platform operated by Point Group GmbH:

1.2 Scope

These General Terms and Conditions (GTC) govern the use of the ImmoPoint platform under the domain immopoint.mk and all associated services. By registering, using the platform or posting a listing, you accept these GTC in full and on a legally binding basis.

1.3 Precedence

These GTC apply to all users, both private individuals and businesses. Deviating terms of the user are not recognised unless ImmoPoint expressly agrees to them in writing.

2.1 Platform function

ImmoPoint provides an online platform on which:

• Real estate offers (purchase, rent, commercial) can be listed and searched
• Contact between providers and interested parties can be established
• Advertising campaigns can be run
• Business accounts for real estate companies and agencies can be maintained

2.2 Intermediary role

ImmoPoint acts solely as an intermediary and platform operator. ImmoPoint is not a real estate agency and does not become a party to any purchase, rental or other contracts between providers and interested parties. All transactions take place directly between users.

2.3 No guarantee of conclusion

ImmoPoint does not guarantee that contracts will be concluded via the platform.

2.4 Availability

ImmoPoint strives for high platform availability but does not guarantee uninterrupted operation. Maintenance work will be announced where possible.

3.1 Registration requirement

Registration is required for posting listings, saving favourites, setting up search alerts and other functions.

3.2 Duty of truthfulness

Complete and truthful information must be provided upon registration. False information entitles ImmoPoint to immediately suspend or delete the account.

3.3 Minimum age

Use of ImmoPoint requires a minimum age of 18 years. By registering, you confirm that you are of legal age.

3.4 Account security

The user account is personal and non-transferable. The user is obliged to keep their access data confidential and to inform ImmoPoint without delay if misuse of the account is suspected.

3.5 Business accounts

Companies, real estate agencies and commercial providers must register as a business account. Business accounts are subject to a verification process:

• Submission of company documents (commercial register extract, UID number)
• Review by ImmoPoint within a reasonable period
• In case of rejection: justification by email, option to resubmit corrected documents
• Unverified business accounts have no access to business functions

3.6 Account deletion by user

Users may delete their account themselves at any time. After deletion, personal data is handled in accordance with the privacy policy. Active paid listings remain visible until the end of the booked term, unless a refund is requested.

4.1 Content and truthfulness

Users are obliged to publish only true, complete and up-to-date information in their listings. In particular, the following details must be stated correctly:

• Property type, location and area
• Price (purchase price or rent)
• Availability
• Features and amenities

4.2 Prohibited content

The following content is expressly prohibited in listings:

• False or misleading information about the property, price or availability
• Discriminatory content (based on origin, religion, gender, etc.)
• Advertising for other platforms or services
• Multiple listings for the same property
• Listings without an actually available property (phantom listings)
• Content that violates applicable law

4.3 Moderation and approval

Every listing is reviewed by ImmoPoint before publication. ImmoPoint reserves the right to:

• Reject listings that violate these GTC or applicable law
• Remove listings without stating reasons
• Edit the content of listings where necessary to comply with the GTC

If a listing is rejected, the user will be informed by email. A refund of fees already paid is made in accordance with Section 6.5.

4.4 Term

The term of a listing begins upon approval by ImmoPoint and corresponds to the booked package term. After the term expires, the listing is automatically deactivated. The user can reactivate the listing by booking a new package.

4.5 Sold/Rented

As soon as a property has been sold or rented, the user is obliged to mark the listing as „Sold“ or „Rented“ or to delete it. After being marked, the listing remains visible for a further 3 days and is then automatically archived.

4.6 Images

Uploaded images must:

• Actually show the listed property
• Be free of third-party rights
• Comply with ImmoPoint's technical requirements

4.7 Number of images

The number of images that can be uploaded depends on the booked package:

• Basic: up to 5 images
• Standard: up to 15 images
• Premium: up to 30 images

5.1 Available packages

ImmoPoint offers the following listing packages (prices in EUR):

• Basic: EUR 3 | 7 days | 5 images | standard position
• Standard: EUR 5 | 14 days | 15 images | highlighted (star), green border
• Premium: EUR 7 | 30 days | 30 images | top position (trophy), green border

5.2 Price changes

ImmoPoint reserves the right to adjust prices and package contents. Existing, already paid listings are not affected by price changes.

5.3 Advertising campaigns

Separate prices apply to advertising campaigns based on the CPM model (Cost per Mille = price per 1,000 impressions). The current CPM prices can be viewed in the Advertising section. Advertising campaigns are also subject to approval by ImmoPoint.

6.1 Payment processing

Payment is processed via the third-party provider Stripe Inc. (USA). By paying, you additionally accept Stripe's terms of use (stripe.com/ch/legal). ImmoPoint does not store any credit card data.

6.2 Time of payment

Payment is due when a package is booked. The listing only goes live after successful payment AND approval by ImmoPoint.

6.3 Currency

All prices are in euros (EUR). When paying in another currency, exchange rate fees may apply, which are borne by the user.

6.4 Invoicing

After successful payment, the user receives a payment confirmation by email. Upon request, ImmoPoint will issue a formal invoice.

6.5 Refund

• Listing rejected: If a paid listing is rejected by ImmoPoint, the full amount is refunded within 14 working days.
• Listing active: After a listing has been activated, there is generally no right to a refund, as the service has been rendered.
• Exceptions: In justified exceptional cases (technical errors on ImmoPoint's part, demonstrable non-performance of the service), ImmoPoint may, at its own discretion, grant a partial or full refund.
• Refund method: Refunds are made via the same payment method used for the original transaction.

6.6 Right of withdrawal

As this concerns digital content that is provided immediately with the user's express consent, the right of withdrawal expires upon commencement of performance. The user expressly confirms this at the time of booking.

7.1 General obligations

Users undertake to:

• Use the platform only for lawful purposes
• Not provide false or misleading information
• Respect the rights of other users
• Not carry out automated access without express permission
• Not distribute malware or harmful code

7.2 Communication

Communication conducted via ImmoPoint must be objective and respectful. Harassment, threats or discriminatory statements are prohibited.

7.3 Duty to report

Users are obliged to report suspicious activities, false listings or violations of these GTC via the reporting function.

8.1 Disclaimer for listings

ImmoPoint does not warrant:

• The accuracy, completeness or timeliness of listings
• The creditworthiness or trustworthiness of users
• The conclusion of contracts between users
• The actual availability of listed properties

8.2 Limitation of liability

ImmoPoint's liability for damages is limited to intent and gross negligence. ImmoPoint is not liable for slight negligence, to the extent permitted by law.

8.3 Liability for third-party content

ImmoPoint is not liable for content posted by users. Upon becoming aware of unlawful content, it will be removed promptly.

8.4 User liability

Users are liable for all damages incurred by ImmoPoint or third parties as a result of a breach of these GTC. Users indemnify ImmoPoint against all third-party claims arising from a breach of these GTC.

9.1 Privacy policy

The collection and processing of personal data is carried out in accordance with the separate privacy policy at immopoint.mk/datenschutz, which forms part of these GTC.

9.2 Applicable data protection law

ImmoPoint processes data in accordance with the Swiss Data Protection Act (DSG) and, where applicable, the GDPR.

9.3 Third-party providers

ImmoPoint uses the following third-party providers:

• Stripe Inc. (payment processing) — USA
• Cloudinary Inc. (image storage) — USA
• Resend Inc. (email delivery) — USA

10.1 Platform content

All content created by ImmoPoint is protected by copyright. Any use without express written permission is prohibited.

10.2 User content

By uploading content, the user grants ImmoPoint a non-exclusive, worldwide, royalty-free right to display it on the platform. This right expires upon deletion of the listing.

10.3 User warranty

The user warrants that they hold all necessary rights to the uploaded content.

11.1 Suspension by ImmoPoint

ImmoPoint reserves the right to suspend or delete accounts in the event of:

• Violations of these GTC
• False information upon registration
• Suspicion of fraud or misuse
• Official orders

11.2 Consequences of suspension

Upon suspension, the user loses access to their account. Services already paid for but not yet rendered will be refunded on a pro-rata basis.

11.3 Termination by user

Users may delete their account at any time via the settings.

12.1 Right to amend

ImmoPoint reserves the right to amend these GTC at any time. Changes will be communicated to users by email at least 30 days before they take effect.

12.2 Consent through continued use

If a user does not object to the amended GTC in writing within 30 days, consent is deemed to have been given.

12.3 Right of objection

In the event of an objection to amended GTC, ImmoPoint has the right to terminate the user account. Services already paid for will be refunded on a pro-rata basis.

13.1 Applicable law

Swiss law applies exclusively, to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

13.2 Place of jurisdiction

The exclusive place of jurisdiction is the registered office of Point Group GmbH in Toffen, Canton of Bern, Switzerland.

13.3 Severability clause

Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.

13.4 Languages

These GTC are available in German, English, Macedonian and Albanian. In the event of discrepancies, the German version shall prevail.
